Eisenführ Speiser was successful for Philips before the Hamburg Higher Regional Court in appeal proceedings for an interim injunction. The client is the owner of a registered Community design which protects the design of a part of a razor. The Chinese opponent Soocas marketed a razor via Amazon in April 2021, which infringes the Community design. After an initial rejection by the Hamburg Regional Court in May, the Higher Regional Court has now granted an interim injunction. Soocas is thus prohibited from marketing, advertising or otherwise putting the shaver in question on the market in the European Union.
