After long delays, the Unitary Patent and the Unified Patent Court are expected to enter into force by the beginning of 2023 at the latest. This represents a significant break in the European patent law system.
Once granted, the Unitary Patent will automatically develop its protective effect in currently 17 European member states, including Germany, France and Italy.
In addition, a new court will be created, the Unified Patent Court, which will be responsible for both questions of validity and questions of infringement of Unitary Patents.
