New publication: Compulsory license under anti-trust law as procedural objection

In the recent edition of the "Mitteilungen der deutschen Patentanwälte" a comment by Dr. Tilman Müller on the recent jurisdiction of the Mannheim District Court was published. The article discusses recent developments regarding the so called "FRAND objection" on the basis of a judgement recently rendered by the Disctric Court. After the "Orange Book Standard" decision of the Federal Court of Justice patent infringers often rely on this objection in their defence against standard essential patents. Namely in the large patent litigations involving mobile phone technology this defence becomes more and more important.
